A garment factory worker who killed his mentally ill brother on Monday was acting in defense of his mother and will not be prosecuted, a court official said on Wednesday.
Khy Ngor, 66, sustained serious injuries to her head and body when one of her sons, Huot Leang Heng, 50, repeatedly hacked her with a meat cleaver for refusing to give him cigarettes, police said on Monday.
Huot Song Heng, 26, rushed to her defense, beating his older brother to death with a stick.
Mr. Song Heng was questioned in the Kandal Provincial Court on Tuesday after admitting to officers at the Sa’ang district police station on Monday that he had killed his brother.
Tep Monin, a court spokesman, said that officers released Mr. Song Heng without charging him on Tuesday because his actions were deemed “necessary for preventing his mother’s death.”
The Criminal Code states that a person who commits an offense in order to protect themselves or others from imminent danger should not be held criminally responsible.
